1.1. These Terms and Conditions (“Terms”) apply to ordering and delivery of Gift Cards via this platform located at www.getyourguide.giftcards-store.com (“GetYourGuide Gift Card Store” and/or “Platform”), which is a website dedicated to selling GetYourGuide corporate Gift Cards to corporate customers, legal entities or agents.
1.2. The Terms apply to contracts for ordering Gift Cards between RLC Solutions GmbH, Schönhauser Allee 141 B, 10437 Berlin, e-mail: info@rlc-solutions.com, registered in the Commercial Register of the Charlottenburg Local Court (HRB 236449 B), represented by the Managing Director Mrs. Rocio Liebana Vinuesa, VAT identification no.: DE355299099 - hereinafter referred to as the "Provider" - and the corporate customer, legal entity or agent - hereinafter referred to as the "Business Customer” or “you" - to be closed.
1.3. Provider and you shall be jointly referred to as “parties”.
1.4. “Gift Cards” shall mean any gift card that is issued by GetYourGuide, sold by the Provider, in electronic format that shall consist of a code and associated visuals and information permitting the holder to redeem this code on www.getyourguide.com to book tours and activities offered by a variety of providers in the country where the Gift Card has been issued.
1.5. The business relationship between the Provider and the Business Customer shall be governed exclusively by these Terms in the version valid at the time of the order. Deviating general terms and conditions of the Business Customer shall not be recognized unless expressly agreed in writing.
1.6. Any Individual Contract between the parties shall prevail in case of inconsistency.
2.1. To use this Platform, you must register a corporate account providing an authorized email and password (“Access Data”). All information must be accurate and kept up to date.
2.2. Provider will review and approve accounts and may request additional documentation.
2.3. Access Data must be kept confidential. Unauthorized use must be reported immediately.
2.4. Two-factor authentication (2FA) may be required via email verification codes.
2.5. You are responsible for all activities under your account. Provider is not liable for misuse.
3.1. Gift Card information and pricing are non-binding prior to contract conclusion.
3.2. Orders are binding once submitted via the Order Form and confirmed by Provider. Provider may refuse orders without justification.
3.3. Gift Cards are available in predefined values (EUR/CHF/GBP/PLN tiers).
3.4. Provider may refuse orders in cases such as fraud suspicion, legal requirements, false information, non-payment, or unverifiable data.
3.5. Provider may terminate the relationship if legal or contractual breaches are suspected.
3.6. Gift Cards are delivered electronically (CSV/Excel files with codes and links) within one working day after payment.
3.7. You warrant lawful use and that any custom content does not infringe third-party rights. You indemnify Provider and GetYourGuide against claims.
3.8. No additional promises about Gift Cards may be made without consent.
3.9. Gift Cards may not be used in promotional campaigns without prior written consent from Provider.
4.1. Gift Cards may only be distributed to customers, employees, or business partners.
4.2. Gift Cards are valid for three (3) years. Only one Gift Card may be redeemed per transaction.
4.3. No interest or cash redemption is possible.
4.4. Gift Cards must be protected from unauthorized access. Lost or stolen cards will not be replaced.
The delivered goods remain the property of the Provider until full payment has been made.
6.1. Gift Cards can be used to book tours and activities on www.getyourguide.com within their validity period.
6.2. Balances are automatically deducted upon use. Current balance can be checked online.
6.3. Additional usage terms are provided with each Gift Card template.
7.1. Prices include VAT where applicable.
7.2. Payment is due immediately upon invoicing.
7.3. Payment must be made via bank transfer with sufficient funds available.
7.4. The Business Customer is responsible for any payment defaults and related costs.
8.1. Both parties comply with GDPR and applicable data protection laws.
8.2. Personal data must be handled confidentially and securely.
8.3. Appropriate technical and organizational measures must be implemented.
8.4. Personal data may include account and recipient details and is processed for contractual and legitimate interests.
8.5. Provider owns Platform content; GetYourGuide owns its trademarks and intellectual property.
Provider is liable for defects in accordance with applicable statutory provisions.
10.1. Liability is limited to direct damages caused by gross negligence or willful misconduct.
10.2. You indemnify Provider against third-party claims arising from misuse or violations.
10.3. Liability exclusions do not apply to death, personal injury, fraud, or legally non-excludable cases.
10.4. Breach of these Terms constitutes breach of any Individual Contract.
11.1. You confirm legal authority to enter into these Terms.
11.2. You must not compromise Platform security or misuse systems.
11.3. Provider may monitor accounts and terminate access for violations.
11.4. Individual Contracts remain fully applicable.
11.5. Provider may amend Terms at any time with immediate effect upon publication.
11.6. Invalid provisions shall not affect the remaining Terms.
11.7. Waivers must be in writing.
11.8. These Terms are governed by German law with jurisdiction in Berlin.
11.9. The UN Convention on Contracts for the International Sale of Goods does not apply.
